These terms are the agreement between you and Night Embers for using the Night Embers app and this website. By creating an account or using the app, you agree to them. If you do not agree, please do not use Night Embers.

1. Adults only

You must be at least 18 years old to use Night Embers. When you create an account you confirm that you are 18 or older and that the date of birth you give is true. We may close any account that we believe belongs to someone under 18.

2. Your account

• You sign in with your email address and a one-time code. Keep access to your email secure, because anyone who can read your email can sign in as you.
• Give accurate information, and do not pretend to be someone else.
• One person per account. Do not share your account.

3. What Night Embers is

Night Embers is a private chat between two people who have both chosen to connect, with a question game inside the chat. Some questions are personal or sexual in nature. Those levels are optional: they are only played when both people have turned them on, and you can change your choices at any time.

We may add, change or remove features, and the service may sometimes be unavailable, especially during early testing.

4. How to behave

You agree not to:

• harass, threaten, pressure or abuse anyone;
• send anything illegal, or anything that sexualizes or endangers minors;
• share another person's messages or answers outside the app without their permission;
• send spam, or invite people who do not want to hear from you;
• try to see another person's answer before the reveal, or access accounts or data that are not yours;
• interfere with the service, probe it for weaknesses, or use automated tools against it.

You can remove a connection at any time from the menu in that chat. To report someone, email support@nightembers.com.

5. Your content

You own the messages and answers you write. You give us permission to store them and show them to you and your connection, which is what the app needs in order to work. You are responsible for what you send.

We may remove content, or suspend or close an account, if these terms are broken or if we need to in order to protect other people.

6. Privacy

Our Privacy Policy explains what we collect and how we use it. Please note that Night Embers is not end-to-end encrypted, and that anything you send can be copied or photographed by the person who receives it.

7. Be careful with people you meet

We do not run background checks or verify who people are. You are responsible for your own choices and safety when talking to or meeting anyone, online or in person.

8. Ending your account

You can stop using Night Embers and delete your account at any time. See Delete your account.

9. No warranty, and limits on liability

Night Embers is provided "as is", without warranties of any kind, to the extent the law allows. To the extent the law allows, we are not liable for indirect or consequential losses, or for the behavior of other users. Nothing in these terms limits rights you have under the law that cannot be limited.

10. Changes to these terms

We may update these terms. If we make a significant change we will tell you in the app or by email. Continuing to use Night Embers after a change means you accept the new terms.
